NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS GIVEAWAY.

VOID WHERE PROHIBITED.

 

 

1.  INTRODUCTION

The Cleaning Authority, LLC (“Sponsor”) is offering an opportunity for you to win a free house cleaning every two weeks for a year (a total of 26 house cleanings) (the “Giveaway”). The Giveaway begins at 11:59 a.m. Eastern Time on April 1, 2012 and ends at 11:59 p.m., Eastern Time on June 30, 2012 (the “Period”).  By entering the Giveaway, entrants unconditionally agree to be bound by and abide by all terms of these Official Rules and the decisions of Sponsor (including, without limitation, decisions regarding eligibility of entries and entrants, and the selection of the winner), whose decisions shall be final and binding.

2.  ELIGIBILITY

Each entrant must, at the time of entry, be eighteen years or older, and a legal resident of the United States. Residents of the states of Alaska, Connecticut, Hawaii, Louisiana, Massachusetts, Mississippi, Montana, North Dakota, Oklahoma, South Dakota, Vermont, West Virginia, and Wyoming are not eligible to enter or win. Only one entry will be accepted per household, as determined by the mailing address of the entrant.  THIS GIVEAWAY IS VOID WHERE PROHIBITED OR RESTRICTED BY LAW.  Each of Sponsor’s and its affiliate’s respective officers, directors, members, employees, advisors, accountants, attorneys, assignees, agents, licensees, and representatives, and any other person or entity associated with this Giveaway (collectively, “Giveaway Entities”), and their immediate family members (defined as parent, spouse, child, siblings and grandparents) are NOT eligible to enter or win.

 

3.  HOW TO PARTICIPATE

 

If you received a brochure with a personalized URL, go to that URL before 11:59 p.m. Eastern Time on June 30, 2012, and follow the instructions to enter.  You must provide your email address and phone number to enter the Giveaway.

 

If you received information on this Giveaway from another source, go to http://www.winfreecleans.com before 11:59 p.m. Eastern Time on June 30, 2012, and follow the instructions for entry. You will be asked to provide your name, address, phone number and email address to enter the Giveaway.

 

The Giveaway is designed to operate with desktop browsers; however, there is no guarantee the Giveaway will operate with your browser.  Internet access fees are the sole responsibility of the entrant.  

 

4.  OPERATION OF GIVEAWAY

Sponsor reserves the right to disqualify all entries that fail to comply fully with these Official Rules and the Sponsor’s Terms of Service, available at http://www.winfreecleans.com. Sponsor assumes no responsibility for lost, misdirected, late, incomplete, or illegible entries or for failure to receive entries for any reason, including, without limitation, transmission failures, technical failures of any kind, malfunctioning of any network, hardware or software, or errors in sending, receiving or processing data, whether originating with sender or Sponsor.  Sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the Giveaway.

 

5.  RULES AND SELECTION OF WINNERS

Entries must be received by Sponsor no later than 11:59 p.m. Eastern Time on June 30, 2012. One winner will be chosen by Sponsor in a random drawing on or about July 2, 2012.

 

6.  PRIZES

One prize will be awarded.  The prize consists of one free house cleaning every two weeks for one year, which is a total of 26 free house cleanings.  The first house cleaning must be scheduled after July 16, 2012 and before July 31, 2012.

 

Prizes must be accepted as awarded.  Prizes are non-assignable and non-transferable. No substitution is allowed, except that Sponsor, in its sole discretion, reserves the right to substitute a prize of equal or greater value.  The value of the prize is taxable as income. Prize winner is solely responsible for all costs, taxes, fees, and applicable federal, state and local taxes regarding the prize.

 

7.  NOTIFICATION OF WINNER

Sponsor will attempt to notify the winner on or about July 2, 2012 by email to the address that Sponsor has on file for the winner.  The name of the winner will be posted at http://www.thecleaningauthority.com on or about July 6, 2012.  Participants are responsible for checking the receipt of all emails and other deliveries.  If the winner cannot be contacted within three days of the first attempted contact, or if eligibility requirements are not met, or if a winner has not or does not otherwise comply with the terms and conditions of this Giveaway, the winner will be deemed ineligible, and another random drawing will be used to select the winner.  The prize must be claimed before July 13, 2012.  Winner may be required to complete an affidavit of eligibility and liability/publicity release (except where prohibited by law), which must be returned within ten days of receipt.  Failure to sign and return the affidavit and/or release within such period, or to comply with any term or condition of these Official Rules, may result in a winner's disqualification and the forfeiture of the winner's prize.  In such event, Sponsor reserves the right to determine if and when a prize will be re-awarded and the applicable terms.

 

8.  General Conditions

This Giveaway is subject to all federal, state and local laws, rules and regulations.  Sponsor reserves the right to disqualify any entry or entries, or any individual, it finds to be tampering with the entry process or the operation of the Giveaway or website; to be acting in violation of these Official Rules; or to be acting in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THIS GIVEAWAY IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

 

9.  PUBLICITY

By entering the Giveaway, each entrant grants Sponsor permission to use the person’s name, likeness, voice, photographs, video, opinions, statements, address and email address, for promotional purposes.  Any use of the forgoing information may be in any manner or media now or hereafter known or existing, worldwide, in perpetuity and without compensation, notice or further consent, unless prohibited by law.

 

10.  Limitations of Liability; Release

If for any reason the Giveaway is not capable of running as planned due to any Internet or software-related problem, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Sponsor, which corrupts or affects the administration, security, fairness, integrity or proper conduct of the Giveaway, Sponsor reserves the right to disqualify any individual who causes any such problem, and to cancel, terminate, modify or suspend the Giveaway. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of entries. Sponsor is not responsible for any problem or technical malfunctions of any telephone network or lines, computer online systems, servers or provider, computer equipment, software, failure of any email or entry to be received by Sponsor or email notices to winners on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including any injury or damage to entrant’s or any other person's computer related to or resulting from participation or downloading any materials in the Giveaway.

 

Sponsor is not responsible for technical, hardware or software failures of any kind, lost or unavailable network connections or failed, incomplete, garbled or delayed transmissions which may limit an entrant's ability to participate in the Giveaway or damage entrant’s system as a result of participation in the Giveaway or downloading any information necessary to participate in the Giveaway. Sponsor also is not responsible for misdirected, lost, late, illegible, forged, destroyed, or incomplete entries or entries not otherwise in compliance with these Official Rules.

 

By entering this Giveaway, each entrant agrees that (i) any and all disputes, claims, and causes of action arising out of or in connection with the Giveaway or the prize awarded, shall be resolved individually, without resort to any form of class action; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs, associated with entering the Giveaway, but in no event will attorneys' fees be awarded or recoverable; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to, punitive, incidental or consequential damages and/or any other damages other than actual out-of-pocket expenses.

 

The winner, by accepting a prize, agrees to release and hold harmless Giveaway Entities from any and all liability, claims or actions of any kind whatsoever, which may result from the award, receipt, enjoyment, ownership or use or misuse of the prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to, loss or destruction of property, or any claims, costs, injuries, losses, or damages related to or based on the entrant's rights of publicity or privacy, or the entrant's claim that he/she has somehow been defamed or portrayed in a false light).

 

Sponsor does not assume any responsibility for any schedule changes in the Giveaway timeline, including without limitation, scheduling conflicts, labor strikes, Acts of God, or other unforeseen events that disrupt the Giveaway schedule. Sponsor reserves the right to cancel, modify, or suspend this Giveaway.

 

ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR GIVEAWAY ENTITIES IN CONNECTION WITH THIS GIVEAWAY SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF MARYLAND WITHOUT GIVING EFFECT TO ANY CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. THE INVALIDITY OR UNENFORCEABILITY OF ANY PROVISION OF THESE RULES SHALL NOT AFFECT THE VALIDITY OR ENFORCEABILITY OF ANY OTHER PROVISION. IN THE EVENT THAT ANY PROVISION IS DETERMINED TO BE INVALID OR OTHERWISE UNENFORCEABLE OR ILLEGAL, THESE RULES SHALL OTHERWISE REMAIN IN EFFECT AND SHALL BE CONSTRUED IN ACCORDANCE WITH THEIR TERMS AS IF THE INVALID OR ILLEGAL PROVISION WERE NOT CONTAINED HEREIN. EACH PERSON WHO PARTICIPATES IN THIS GIVEAWAY AGREES THAT THE STATE AND FEDERAL COURTS LOCATED IN BALTIMORE, MARYLAND HAVE EXCLUSIVE JURISDICTION OVER ANY SUIT OR OTHER PROCEEDING ARISING OUT OF OR BASED UPON THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR GIVEAWAY ENTITIES IN CONNECTION WITH THIS GIVEAWAY AND EACH HEREBY WAIVES ANY CLAIM THAT IS NOT SUBJECT PERSONALLY TO THE JURISDICTION OF SAID COURTS OR THAT ANY SUCH SUIT OR OTHER PROCEEDING IS BROUGHT IN AN INCONVENIENT FORUM OR IMPROPER VENUE.

 

11. DATA COLLECTION  Sponsor collects personal information from entrants when they enter the Giveaway.  The information collected is subject to the Privacy Policy of Sponsor located at http://www.thecleaningauthority.com; however, YOUR ENTRY CONSTITUTES YOUR AGREEMENT THAT THE PERSONAL INFORMATION YOU PROVIDE MAY BE USED AND DISCLOSED IN ACCORDANCE WITH THESE OFFICIAL RULES. DO NOT ENTER THIS GIVEAWAY IF DO NOT AGREE TO THE USE AND DISCLOSURE OF YOUR PERSONAL INFORMATION.
